SALT LAKE CITY — A man is suing Unified Police and Salt Lake County after he was shot during a police chase last year in Kearns.

21 year old Damian Scott Huth says the officer’s use of deadly force violated his constitutional rights.

Last October Huth had an outstanding warrant, and ran from an officer trying to take him into custody.

At some point during the chase a Unified Police detective fired a shot that hit Huth in the shoulder.

Investigators concluded the shooting was accidental, but this lawsuit disputes that.

He wants nearly 2.5 million dollars in punitive damages and compensation for pain and suffering.
