Appeals court upholds conviction for Utah deputy’s killer

DENVER — A federal appeals court has upheld the murder conviction of the man who killed a Millard County Sheriff’s deputy in 2010.
The Tenth Circuit Court ruled federal prosecutors did not put Roberto Roman in double jeopardy after the Utah court tossed his murder case on a technicality.
The judges also found sufficient evidence that he killed Millard County Sheriff’s Deputy Josie Greathouse Fox — with an AK-47 — while her brother sat in Roman’s truck after a drug deal.
The appellate decision admits Roman is building his case for a possible Supreme Court appeal.
